Dispensary Application Forms Now Available in Massachusetts

dph_logo_to_use_6_07The Massachusetts Department of Public Health (DPH) has published the Phase I application forms for those interested in opening a dispensary in the state. The application process is described in detail in these instructions that was also released today by DPH, but below is some of the basic information about how to apply.

There are two phases to the written application process for those wishing to open a Registered Medical Dispensary (RMD). Before beginning the written application, applicants should familiarize themselves with DPH’s regulations, particular the specific regulations dealing with dispensary operation. DPH can register up to 35 RMDs in the state, with no more than 5 in any single county.

In Phase I, applicants are to fill out the 7-page application, and submit 1 original and 10 hardcopies of the application and any supporting documents, a CD containing the application form and scans of any supporting documents, and a $1,500 application fee. Applications must be submitted by Thursday, August 22, 2013, and applications received after 3:00 p.m. on the 22nd will not be considered. DPH expects to announce the applicants who make it to Phase II on Wednesday, September 18, 2013.

One of the several criteria for making it to Phase II is that prospective RMD applicants will need to be able to demonstrate that they have at least $500,000 in available capital. Applicants can submit up to 3 applications for separate RMD locations. Those submitting multiple applications need to show $500,000 for one RMD, and $400,000 in available capital for each of their subsequent applications.  The amount of capital that an applicant must have available is certainly steep, but is only a quarter of the $2 million that neighboring Connecticut is requiring, and unlike Connecticut, the $500,000 does not have to be held in an escrow account.

With today’s publication of the RMD applications forms, Massachusetts DPH is continuing to demonstrate their timely and thoughtful implementation of the state’s medical marijuana program. Questions about Phase I applications must be submitted in writing and sent to RMDApplications@state.ma.us or faxed to (617) 624-5206 no later than Wednesday, August 14th.
